Can cardiovascular exercises really change the body physically?

Well, I’m closing in on one year at the gym. Five hundred dollars spent and I’m supposed to have a different body and different outlook on life. The keyword is supposed. Now, keep in mind for those who are asking themselves if I kept a regular schedule, if I ate the right foods, or if I cut out certain lifestyle activities in which I was accustomed. The answer is all yes. To give you a brief synopsis, I’m about 6’2″ tall, 192 pounds, with a 34 inch waist. I have a fairly athletic build all ready as I trained to become a professional wrestler in college. (Consequently, I did not pursue that dream as to settle down, get married, and have children.) My main objective (after my now ex-wife left) was to just get in the gym, stay motivated, and, possibly, trim a little belly fat. I knew I wasn’t going to be Hercules – not even close. I wasn’t in there to eventually bench press 300 pounds or push 600 pounds on my legs. That’s silly at my age. It was more cardiovascular conditioning and burning the belly fat.

So, Monday through Thursday I endured 30 hard minutes of cardiovascular exercise such as the treadmill, stairstepper, or bicycle. Then, I alternated a lower body workout (Monday and Wednesday) with an upper body workout (Tuesday and Thursday). For nine solid months, I consistently weighed 183 pounds. That’s taking a daily multi-vitamin and a protein shake per day. It’s like my body just absorbed every thing. Was there a difference in my energy level? Possibly – however, I couldn’t tell. I ate the fruits, the veggies, the grilled chicken, the fish, the protein, and, yes, for three solid months I even cut out beer and desserts.

Now, did I begin to date and feel better about myself? Sure. Did I think my arms and legs were bigger? Sure. But, I think it was all a placebo effect as my arms, chest, and legs never actually grew. So, I started doing more home aerobics and the simple exercises such as barbell curls, rowing exercises, and crunches. All basically targeting the same body areas but not on any machines.

So, this leads me to the question of the day. Are we genetically pre-dispositioned to a certain body type no matter what we do to change it? (Keep in mind, we’re not including surgery here.) Everyone on the paternal side of the family is short and stocky. I believe my height is inherited from a few great uncles on the maternal side. Although I have eventually gained ten pounds, I feel like I have subjected myself to everything in my power to reduce the size of my little “pooch”. I was miserable, to say the least, without an occasional beer (maybe two per week) or slice of pumpkin pie or coconut cake. I’m happier now. I can see my belt which matters the most and I can see everything below it which is the most important. I walk and jog for my cardiovascular exercise which, after all, is about elevating the heart rate two to three times per week for about 20 minutes. I lift my 110 pound barbell for three or four sets of exercises two to three times per week. I’m also swimming now that the pool is open at my complex. My energy level is the same. My confidence level is the same. Plus, I’m saving money and my exercise occurs at my convenience – not during gym hours. Not that I’m discouraging a gym membership but the purpose of this article is to debate whether we are bound to genetics in a physical sense no matter what we do to change it.

My answer is obviously in the affirmative that we can change our bodies slightly (non-surgically, again) but will never truly alter what we are pre-determined (possibly pre-destined) to become physically.

Technology spending for hardware, software and consulting services accounts for a significant portion of most health care providers budgets today, especially since the Obama Stimulus Plan and HITECH Act are incentivizing providers to implement electronic health records. In a perfect world, technology works perfectly, improves efficiency and the quality of care and makes life easier for the provider. However, the real world is not perfect and things can, and do, go wrong with technology products and services after you purchase and/or license them from third party vendors. Technology contracts generally are written by the vendors and consultants. Unfortunately, many technology contracts fall short of giving providers adequate protection and often contain hidden pitfalls and costs. Despite this fact, many providers never give these contracts to experienced health lawyers to help them negotiate better terms and protections for their high-tech investments BEFORE signing. This is a potentially costly practice. Every health care provider should be concerned with at least the following FOUR KEY ISSUES, which should be addressed in any technology contract:

Warranties and Limitations of Liability: Despite elaborate sales presentations, technology contracts typically disclaim most, if not all, warranties and limit the liability of vendors to only refunding all or part of the purchase or license price paid for the technology. Such refunds are inadequate to protect the average provider when problems arise. A technology vendor should be required to give a written warranty in the contract that its product will perform in accordance with documented standards and for a reasonable period of time. At a minimum, this time period should be long enough for the provider to evaluate the technology in its operations. A better solution is to require a warranty for the useful life of the technology, or as long as there is a support and maintenance service agreement in place. A vendor also should not be allowed contractually to limit its liability on default only to return of the purchase price. If a provider suffers actual damages caused by the technology, the vendor should be required, in writing, to stand behind its product and services and reimburse such damages. A reasonable compromise is to require the vendor at least to tender the limits of its insurance coverage, which creates minimal additional risk to the vendor while better protecting the provider.

Payments & Performance: A provider should not agree to pay the full purchase price up front, as is often a contract requirement, leaving the vendor with little incentive to complete its responsibilities. The parties should mutually agree in advance upon a project timetable with milestone targets for delivery and implementation of the technology. Payments should be made in installments conditioned upon reaching the targets. In addition, providers should build in testing rights, in order to evaluate whether the technology is performing as promised. The provider always should have the final say in whether a test provides a successful outcome and whether the final payment should be made to the vendor.

Support and Maintenance: A technology hardware purchase or software license is only as good as the support and maintenance that goes along with it. The vendor should be willing to provide support for at least a defined useful life of the technology. Several questions should be answered in a written support agreement. Are updates or upgrades provided without additional charge? Will the vendor perform on-site or off-site support and maintenance? Will the provider pay a monthly fee plus an hourly charge or is there only an hourly charge? Does the hourly charge differ depending on when or what level of support is needed? Do the charges increase over the term of the support agreement? What is the vendor agreeing to support? Will changes made to the technology by the provider automatically terminate the warranty or support obligations? Unless the contract is specific regarding essential issues, a provider may find itself paying for less or different support and/or maintenance services than needed or expected.

Confidentiality: Confidentiality of patient health information is a critical issue. Federal HIPAA law has a variety of privacy and security rules providers and their business associates must follow. In addition, some states, including Florida, have enacted legislation that requires entities that conduct business in the state and which maintain computerized data that contains personal information to provide notice to any resident if there is a breach of security. A technology contract should specify if the vendor will have access to any of the confidential patient information. A health care provider must require the vendor and its employees to maintain the confidentiality of such information under federal and many state laws. The technology contract also should expressly protect the confidentiality of provider trade secrets and other proprietary information to which a vendor or consultant may have access.

Although technology contracts may appear intimidating, as they frequently are presented by vendors in small print and columned format, leading providers to believe they are non-negotiable forms, this is not the case in most instances. We’ve all heard the adage that an ounce of prevention is worth a pound of cure, yet it often seems that most people ignore this advice. Otherwise people would not be dying from smoking-related cancers and the plethora of illnesses caused by obesity. It’s easy to say that these are personal problems and that people need to take better care of themselves. But it’s worth considering whether the insurance industry has any moral obligation to do more in terms of preventing major illnesses before they manifest symptoms in people.

Most of our business is individual/family health insurance in Colorado, and we are very familiar with all of the major policies offered in Colorado. In the PPO market, we have been conditioned to think that if a health insurance company is offering $300 or $500 in preventative care each year, they are providing “great preventative benefits.” By Colorado law, all policies are required to cover mammograms for women and PSA exams for men, with no deductible. That’s it as far as what insurance companies HAVE to cover. Notice that pap smears are not on the list. Nor are colonoscopies or blood screenings or stress tests. If you have a policy with a $300 annual limit on preventative care, it’s pretty easy to use that up with one pap smear and a basic check up. It would be nice to think that everyone is concerned enough about their health that they would be willing to save enough money to pay for their own colonoscopies (not a cheap procedure) and dermatologist skin screenings. However, I think we all know that it’s not likely to be something that a significant number of people can or will pay for themselves. Instead, most people who don’t have insurance coverage for these things (especially the expensive ones) just don’t get them done.

Without considering the moral obligations of companies whose job is to pay for healthcare, why not consider the financial ramifications of paying for preventative care. In the past, many diseases were nowhere near as treatable as they are today. Some diseases that were considered terminal even 10 years ago, now have longer survival rates and in some cases can become manageable chronic conditions. Let’s look at this as a purely numbers-based issue (a bit morbid considering it’s peoples’ lives we’re discussing, but I understand that insurance is a business). 15 years ago, perhaps it made financial sense for insurance companies to limit coverage for preventative care. That way, illnesses wouldn’t be detected until they were at an advanced stage, and sadly enough, the person might die before the health insurance carrier had paid out much money for treatment. If the disease had been caught early, the health insurance company would have likely paid much more for the treatment. With all of the advancements in medical technology, even diseases that are caught in later stages today often have a decent prognosis, and treatment can add years to patients’ lives.

So insurance companies will be paying for extended treatment whether the disease is caught early or not. And often the treatment for advanced-stage diseases is much more expensive than it would have been had the condition been caught early (for example, consider the cost of open-heart surgery versus a regimen to lower cholesterol before the problem warrants a quadruple bypass). Removing colon polyps detected early through a colonoscopy is much less expensive than treatment for colon cancer, yet colonoscopies are almost never covered by Colorado health insurance companies. This seems counter-productive.
